1. Orders are accepted only upon and subject to the conditions of sale of H2O Plus Bathrooms as set out herein.

2. Quotations and printed prices are subject to alteration or withdrawal without notice.

3. Goods will be invoiced at the prices ruling at time of delivery (including the rate of Vale Added Tax applicable).

4. Delivery shall be deemed when the goods are unloaded at or delivered to the Customer’s premises or other delivery location agreed between H2O Plus Bathrooms and the Customer except, if the Customer collects or arranges collection of the goods from H2O Plus Bathroom’s premises or nominates a carrier for the goods delivery shall be deemed when the goods are loaded on to the collection or carrier’s vehicle.

5. It shall be the responsibility of the Customer to check goods carefully on delivery and a clear signature shall be given by the recipient. The Customer shall accept goods when tendered for delivery and shall ensure that an authorised person is available to take delivery. Any person signing for goods delivered shall be deemed to be authorised for this purpose by the Customer.

6. Goods found defective at point of delivery will be credited if the defects are such that H2O Plus Bathrooms are responsible, and provided written complaint is made immediately on delivery. No allowance will be made for labour, transport charges or any consequential expenses.

7. H2O Plus Bathrooms will store goods for up to four weeks after the agreed delivery date. However if delivery of the goods is delayed through any act or ommision by the Customer, the company may either:
(i) put the goods into storage at the Customers’risk and expense, (ii) return the goods to the supplier; all handling and restocking charges to be met by the Customer.

8. Time of delivery shall not be of the essence of the contract. Offers for delivery from stock are made subject to the goods being available on receipt of order.

9. The ownership of goods supplied to the Customer by H2O Plus Bathrooms shall remain with H2O Plus
Bathrooms and shall pass to the Customer when:
(i) the Customer has paid in full for such goods, and
(ii) the Customer has paid in full all monies owed to H2O Plus Bathrooms in respect of any other goods
supplied to the Customer by H2O Plus Bathrooms.

10. H2O Plus Bathrooms reserve the right to withhold delivery of the whole or part order for goods if payment by the Customer is overdue for goods previously supplied.

11. Risk in all goods shall pass to the Customer from the moment when the goods are delivered and thereafter until title passes hereunder the Customer shall indemnify H2O Plus Bathrooms against all loss or damage to the goods and shall insure them on their full replacement value against all risks that a prudent owner would insure.

12. H2O Plus Bathrooms reserve the right to refuse countermands particularly in the case of goods for despatch or in process of manufacture. Cancellation of orders for, and return of special goods, cannot be entertained under any circumstances. All other exceptional returns that are accepted will be subject to a minimum handling charge of 25% of the full retail price plus applicable carriage charges.

13. These conditions shall in all respects be construed in accordance with the Laws of England. Customer’s official orders containing special conditions are binding only in so far as such conditions are not in variance with the terms and conditions herein.
